On Thursday January 19, 2012, under the Customs Advisory Council a meeting was held where the issue of the General Resolution N º 3252/12 - AFIP (Affidavit Advance Import - DJAI) implementation was discussed.
The meeting was chaired by Ms Siomara Ayeran (General Director of Customs), Dr. Pedro Roveda (Deputy Director of the Customs Assistant-Directorate Legal Technique) and Mr. Silvio Minisini (Deputy Director of the General Sub-Directorate of Customs Control). The said officials stressed that for the World Customs Organization (WCO), within the Framework of Standards advanced information is considered to secure and facilitate Global Trade", a "basic element that contributes to the customs information exchange" therefore, it is not considered a lock for final destinations of imports for consumption.
Following there is a synthesis of the treated issues:
1) achieved sub-regimes:
• ECA1 (Exit for consumption to the Continental Homeland from the Special Customs Area of goods originated from the Special Customs Area for consumption by the same producer.)
• ACE2 (Exit for consumption to the Continental Homeland from the Special Customs Area of goods originated from the Special Customs Area for consumption by a different importer CUIT from that of the producer.)
• ECA3 (Exit for consumption to the Continental Homeland from the Special Customs Area of non-originated goods from the Special Customs Area.)
• IC01 (Imports for consumption of goods arriving without transport document by post or by own means.)
• IC02 (Imports for consumption of perishable goods, subject to prior application scheme.)
• IC03 (Import arrivals for consumption of goods in fractioned shipping and destined from the first fraction arrival.)
• IC04 (Importation of goods destined for consumption after the arrival of the transport means with the transport document, with entrance to warehouse.)
• IC05 (Imports for consumption of goods whose destination can be registered prior to the arrival of the conveyance for direct to market shipment.)
• IC06 (Imports for consumption of goods previously intended storage tank)
• IC07 (Imports for consumption of goods included in the automotive regime whose destination can be registered prior to the arrival of the conveyance for direct to market shipment.)
• IC65 (Imports for Consumption of Bulk Direct to Market with Registered Mani.)
• IC75 (Imports to Consumption with Transport Document Direct to Market Form7366 Registered Mini.)
• IG01 (Imports for consumption without transport document by undertakings within the In-House Customs regime.)
• IG03 (Import for consumption of goods in fractioned shipping and destined from the arrival of the first fraction by firms covered by the In-House Customs Regime)
• IG04 (Import of goods for consumption destined after the arrival of the transport means entering warehouse by firms covered by the In-House Custom Regime)
• IG05 (Imports for consumption for the In-House Customs Regime of goods whose destination can be registered prior to the arrival of the carrier medium.)
• IG06 (Imports for consumption of goods previously destined to storage by firms covered by the In-House Customs Regime.)
• IG07 (Imports for consumption of goods included in the automotive regime for firms covered by the In-House Customs Regime.)
• ZFE1 (Exit from the Free Zone for consumption in the customs territory.)
2) Exceptions to the scheme:
• Precedent Destination of Temporary Import (Decree 1001/82 - Decree 1330-1304.)
• The Nationalization of those temporarily admitted goods covered by the Decree 1001/82 and Decree 1330/04.
• Re-importation Regime of Exported Goods for Consumption.
• Sample Regime.
• Donations.
• Import Regime for Compensating Delivery of Defective Goods.
• Diplomatic Franchise Regime.
• Courier Regime.
• Authorized prior to February 1, 2012 partial shipments.
• Turn Key Plant System (APPROVED).
• Postal Shipping Regime.
• Letters of Credit opened prior to January 31, 2012, whose merchandise were shipped after February 1, 2012, will be processed by a special advantage and assigned orange channel of selectivity.
• Equal treatment will receive those goods partly or fully paid by the due date mentioned above.
3) Overview:
Special cases will be treated as urgent as an exception (for example, among other, key parts for production, medicines, etc..).
From the presentation of the DJAI application, the Federal Administration of Public Revenue will issue within the next 48 to 72 working hours, applying only systemic control on them. Information is electronically sent to the organism that is currently attached to the Ministry of Internal Trade for it to intervene.
The intent of the AFIP is that DJAIs get their judjement within a term of no more than 10 business days.
The DJAI may be drawn up by the importer or by the Customs Broker, both through the KIT in the Maria Information System.
Data to be entered in the Affidavit Advance Import (DJAI):
• TIN of Importer (CUIT, in Spanish).
• Legal Name.
• TIN of the Customs Broker (only if involved).
• Currency.
• Description of Goods.
• Unit price.
• total FOB.
• Tariff Position at SIM level.
• Marketing Unit.
• Quantity.
• Country of Origin.
• Country of Procedence.
• State of the Merchandise.
• Incoterms.
There will be a tolerance of plus / minus 5% of the FOB amount.
The DJAI validity will be of extendable 180 days.
S several DJAI can be applied on one import clearance as well as on the same DJAI multiple offices may be registered.
The DJAI are not transferable. In the event of a sale in the Primary Customs Zone as well as in a free zone, the purchaser must subordinate his DJAI to his vendor's with a new registration.
The DJAI status will be communicated by E-Window and by MOA (My Customs Operations).
The DJAI whose merchandise is shipped after the deadline will be timely treated by the General Department of Customs Control.
The goods entered into free trade zones must obtain DJAI if they come out (ZFE1) after January 31, 2012.
